1. Who you are dealing with
Scents & Cosmetics by Mfundo is a South African retail business selling fragrance, cosmetics and human blended hair online at scentsbymfundo.co.za and in person from Berea, Durban, KwaZulu-Natal, South Africa. Throughout these terms, “we”, “us” and “our” mean Scents & Cosmetics by Mfundo, and “you” means the person placing an order.
These terms, together with our Privacy Policy, Refund Policy, Cancellation Policy and Shipping & Delivery Policy, form the agreement between us. Placing an order means you accept them.
2. Placing an order
You must be 18 or older, or have the permission of a parent or guardian, to buy from this site. Adding items to your bag and paying is an offer to buy; the agreement comes into being when we confirm your order by email and the payment has cleared.
We may decline an order — for example if the item has sold out, if the price was published in error, or if we cannot verify the payment. If we decline an order you have already paid for, we refund you in full.
3. Prices
All prices are shown in South African rand (ZAR) and include everything except delivery, which is added at checkout and shown to you before you pay. There are no other charges, and no amount is added after checkout.
We are not a registered VAT vendor, so no VAT is charged on your order.
Prices and availability can change without notice, but a change never affects an order we have already confirmed. If an item is listed at an obviously incorrect price, we will contact you before processing the order rather than simply cancelling it.
4. Payment
We accept card, instant EFT, SnapScan and Mobicred through Payfast, and ordinary bank transfer (EFT) on request. Card details are captured on Payfast’s own secure systems — they never reach this website, and we never see or store them.
Where you pay by ordinary bank transfer, we hold your order for three working days and release it once the payment reflects in our account.
5. Products
Everything we sell is sourced from suppliers we buy from directly. We do not sell replicas or decanted fragrance.
We describe and photograph products as accurately as we can, but screens render colour differently and manufacturers change packaging, so slight variation between the photograph and the item you receive is possible and is not a defect.
6. Delivery
We deliver within South Africa only. Delivery options, costs and timeframes are set out in full in our Shipping & Delivery Policy. Delivery times are estimates provided by our delivery partners and are counted in working days from the day payment clears.
Risk in the goods passes to you on delivery, or on collection if you chose to collect.
7. Cancellation, returns and refunds
You may cancel an order before it ships, and you have a seven-day cooling-off right under section 44 of the Electronic Communications and Transactions Act. The detail is in our Cancellation Policy and Refund Policy, both of which form part of these terms.
8. Faulty goods
Under sections 55 and 56 of the Consumer Protection Act you are entitled to goods that are of good quality, in working order and free of defects. If goods fail that standard within six months of delivery you may return them, at our cost, and choose a repair, a replacement or a refund. Nothing in these terms limits that right.
9. Your account
If you create an account, keep your password to yourself and tell us straight away if you think someone else has used it. You are responsible for orders placed from your account.
10. Our liability
We are responsible for delivering the goods you ordered, in the condition described. We are not liable for indirect or consequential loss, or for delays caused by events outside our reasonable control such as courier disruption, load shedding, or a national shutdown. Nothing here excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act.
11. Intellectual property
The text, photographs, logo and layout on this site belong to Scents & Cosmetics by Mfundo or to our suppliers, and may not be copied or reused without our written permission.
12. Complaints and disputes
Tell us first — email hello@scentsbymfundo.co.za or WhatsApp 079 615 7182 and we will try to resolve it within seven working days. If we cannot, you may refer the matter to the National Consumer Commission or an accredited consumer-goods ombud. Nothing stops you approaching a court.
13. Governing law
These terms are governed by the law of the Republic of South Africa, and any dispute is subject to the jurisdiction of the South African courts.
14. Changes to these terms
We may update these terms from time to time. The version published on this page when you place an order is the version that applies to that order.
