1. Who is responsible for your information

Scents & Cosmetics by Mfundo, of Berea, Durban, KwaZulu-Natal, South Africa, is the responsible party for the personal information collected through scentsbymfundo.co.za, as that term is used in the Protection of Personal Information Act (POPIA). 2. What we collect

  • Order information: your name, delivery address, email address and phone number, and what you bought.
  • Account information: your username and a securely hashed password, if you create an account.
  • Communications: the messages you send us by email, WhatsApp or the contact form.
  • Technical information: your IP address, browser type and the pages you visit, collected by the website and its cookies.

We never collect, see or store your card details. Card and banking information is entered on Payfast’s own secure payment page and stays with them.

3. Why we use it, and on what basis

  • To take, process, pack and deliver your order, and to handle returns — this is necessary to perform our contract with you.
  • To contact you about your order, including delivery updates.
  • To keep the accounting and tax records the law requires us to keep.
  • To detect and prevent fraudulent transactions — our legitimate interest, and yours.
  • To send you news about new stock and specials — only where you have asked us to. Every such message carries an unsubscribe link.

4. Who we share it with

Only the parties who need it to get your order to you, and only what they need:

  • Payfast (Pty) Ltd — to process your payment.
  • Our delivery partners — Paxi (PEP), Pudo and our courier — to deliver your parcel.
  • Twilio SendGrid — to send order and account email on our behalf.
  • Our hosting provider — which stores the website and its database.

We do not sell your personal information to anyone, ever. We will disclose information where the law requires it, and no further.

5. Information sent outside South Africa

Our email is delivered through Twilio SendGrid, which processes data outside South Africa. We rely on that provider’s contractual data-protection commitments, which POPIA section 72 permits.

6. How we protect it

The site runs over an encrypted HTTPS connection, administrative access is limited and password protected, and payment information never touches our systems. No system is perfect, but if a breach ever affected your information we would notify you and the Information Regulator as POPIA requires.

7. How long we keep it

Order and invoice records are kept for five years, as tax and consumer protection law requires. Account details are kept until you ask us to close the account. Marketing contact details are kept until you unsubscribe.

8. Your rights

You may ask us what personal information we hold about you, ask us to correct or delete it, object to how we use it, or withdraw your consent to marketing at any time. Email hello@scentsbymfundo.co.za and we will act on it within a reasonable time and at no charge.

If you are not satisfied with how we have handled your information, you may complain to the Information Regulator of South Africa: complaints.IR@justice.gov.za, or inforegulator.org.za.

9. Cookies

We use cookies to keep your shopping bag working between pages, to keep you signed in, and to understand in general terms how the site is used. You can block cookies in your browser settings, but the shopping bag and checkout will stop working if you do.

10. Children

This shop is not intended for children under 18, and we do not knowingly collect their information.
